Notice to Comply (NTC)

There are situations where an educational approach is more effective than an enforcement action in achieving compliance with District rules and regulations. These situations do not involve emissions violations and usually involve first time violations committed by members of the general public or business who are not fully aware of District Rules and Regulations. District Rule 3.12 – Notice to Comply Rule establishes criteria whereby minor violations may be issued a NTC in lieu of a Notice of Violation (NOV).

The NTC will specify what action is required by the operator in order to return to compliance.

PENALTY FOR FAILURE TO COMPLY: Any person or facility who fails to comply with the required actions by the date specified on the NTC will be issued a NOV which is subject to further legal action pursuant to the California Health and Safety Code, Section 42400, et. seq.
