Prohibitory rules - State Law - Federal Regulations
In addition to NSR, when the District is processing ATC applications, the District must verify and document compliance with all other applicable rules and regulations, including the following:
- District prohibitory rules - these are rules listed in Regulation II of the District rules and regulations that are written to achieve emission reductions from specific source categories or from all sources. These rules are applicable to existing sources (retrofit requirements) as well as new sources. Examples of source specific prohibitory rules include Rule 2.22 applicable to gasoline dispensing facilities, and Rule 2.32 applicable to stationary internal combustion engines. Examples of prohibitory rules applicable to all sources include Rule 2.3 for visible emissions and Rule 2.5 for nuisance.
- State laws - these are regulations that are promulgated by the California Air Resources Board (ARB) or state legislature that the District must enforce. Examples include Air Toxic Control Measures (ATCMs) for drycleaning operations and diesel engines.
- Federal regulations - these are regulations that are promulgated by the United States Environmental Protection Agency (US EPA) or congress. Examples include New Source Performance Standards (NSPS) and National Emission Standards for Hazardous Air Pollutants (NESHAPs).
